Frequently Asked Questions
Everything you need to know about creating a bill of sale with BillOfSaleKit.
General Questions
A bill of sale is a legal document that records the transfer of ownership of personal property from a seller to a buyer. It includes details about both parties, a description of the item being sold, the sale price, and the date of the transaction. A bill of sale serves as proof of purchase and protects both the buyer and the seller in the event of a dispute.
A bill of sale provides legal proof that a transaction took place. Buyers need it to register a vehicle with the DMV, prove ownership, and document what they paid. Sellers need it to prove they no longer own the item, which protects them from liability. Many states legally require a bill of sale for motor vehicle transactions.
Yes. A properly completed and signed bill of sale is a legally recognized document in all 50 states. It serves as written evidence of a sale and can be used in court to prove ownership transfer. For the document to be valid, both the buyer and seller should sign it, and the information must be accurate.
Most states do not require notarization for a bill of sale to be valid. However, some states including Louisiana, Nebraska, Montana, Maryland, and West Virginia require or strongly recommend notarization for vehicle transactions. Check our state-specific pages for the requirements in your state.
BillOfSaleKit supports bills of sale for cars, motorcycles, boats, trailers, RVs/campers, heavy equipment, and general personal property. Each document type includes fields specific to that type of property, such as VIN numbers for vehicles or hull identification numbers for boats.

Legal
No. BillOfSaleKit is not a law firm and does not provide legal advice. We provide self-service document templates based on common state requirements. If you have specific legal questions about your transaction, we recommend consulting with a licensed attorney in your state.
Our documents are professionally formatted and include the fields required by each state. While DMV requirements can vary by location and may change, our templates are designed to meet the standard requirements for vehicle title transfers. If your local DMV has specific form requirements, check with them before your visit.
Most states do not require witnesses for a bill of sale to be valid. The document generally only needs to be signed by the buyer and seller. However, having a witness can provide additional legal protection. A few states recommend or require witnesses for certain types of transactions.
Before signing, both parties should verify: the full legal names and addresses of the buyer and seller, the complete and accurate description of the item (including VIN, hull ID, or serial number), the agreed-upon sale price, the date of the transaction, and any conditions of the sale such as "as-is" or warranty terms.
We recommend keeping your bill of sale permanently or at minimum until the item is sold, traded, or disposed of. Buyers should keep it as proof of purchase and for insurance purposes. Sellers should keep a copy as proof they transferred ownership, which protects them from future liability claims.
